3. Orders and Conclusion of the Purchase Agreement
The Buyer selects the goods, their variant, size and quantity and adds them to the shopping cart.
Before submitting the order, the Buyer has the opportunity to review and correct the entered information, the contents of the order, the delivery method and the payment method.
Before submitting the order, the Buyer is informed of the total price of the order, including any delivery costs and other applicable fees.
By submitting the order using a button that clearly indicates an obligation to pay, the Buyer confirms that the order entails an obligation to make payment.
After receiving the order, the Seller will send confirmation of receipt of the order to the e-mail address provided by the Buyer.
The Seller reserves the right to cancel an order, particularly if the ordered goods cannot be supplied, if there has been an obvious technical error in the stated price or product availability, or if there is another objective reason preventing fulfilment of the order. If the Buyer has already paid the purchase price, the Seller will refund the relevant payment. Pasted markdown
4. Prices
All product prices are stated in euros (€).
The Seller is not registered for VAT.
Delivery costs or other charges may be added to the price of the goods. The Buyer will be informed of these costs before submitting the order.
The total price of the order is displayed to the Buyer before the order is submitted with an obligation to pay.
The Seller reserves the right to change product prices. A price change does not affect purchase agreements that have already been concluded.
Where the Seller offers a discount, information concerning the price reduction will be provided in accordance with applicable legislation. Pasted markdown
5. Payment Terms
The Buyer may pay for the order using the payment methods currently available in the online store, in particular:
- payment card or a supported online payment method,
- bank transfer,
- cash on delivery,
- or another payment method offered during the checkout process.
The specific payment methods available and any applicable fees are displayed to the Buyer before the order is submitted. Pasted markdown
6. Delivery Terms
The Seller delivers goods using the delivery methods offered in the online store.
The delivery price is displayed during the ordering process and is available to the Buyer before the order is submitted with an obligation to pay.
The estimated delivery time is specified on the product page or during the checkout process. Unless otherwise stated, the Seller will deliver the goods without undue delay within the period stipulated by applicable legislation.
If the Seller determines that the ordered goods cannot be delivered, the Seller will contact the Buyer to agree on further steps. If the order has already been paid for and no agreement on alternative fulfilment is reached, the Seller will refund the amount paid.
The Buyer is responsible for providing accurate and complete information required for delivery. Pasted markdown
7. Receipt of the Shipment
The Buyer is advised to check the condition of the packaging upon receipt of the shipment.
If the shipment is visibly damaged, the Buyer may report the damage to the carrier and the Seller when receiving the goods. This does not affect the Buyer's statutory rights arising from the Seller's liability for defects.
The risk of accidental damage to or loss of the goods passes to the Consumer when the Consumer, or a third party designated by the Consumer who is not the carrier, takes possession of the goods, unless otherwise provided by applicable legislation. Pasted markdown
8. Withdrawal from the Contract – 14-Day Returns
When purchasing at a distance, the Consumer generally has the right to withdraw from the contract without giving a reason within the statutory period of 14 days.
Under Act No. 108/2024 Coll. on Consumer Protection, specifically Section 21(3), the Consumer bears the costs of returning the goods when withdrawing from the contract. This does not apply if the Seller has agreed to bear such costs or if the Consumer was not properly informed in advance that they would be responsible for the return costs.
A notice of withdrawal may be sent to:
E-mail: vinight@vinight.sk
Address: Riadok 415/47, Drahovce, 92241
The withdrawal period is observed if the Consumer sends the notice of withdrawal no later than on the final day of the applicable period.
The Consumer must subsequently send or hand over the goods to the Seller no later than 14 days after withdrawing from the contract, unless otherwise agreed with the Seller.
The direct costs of returning the goods are borne by the Consumer unless the Seller determines otherwise.
The Consumer is liable for any diminished value of the goods resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functionality.
In the case of clothing, the Consumer may reasonably try on the goods in a manner comparable to what would be possible in a physical retail store. It is recommended that returned goods are clean and undamaged.
The Seller will refund the payments that it is legally required to refund no later than 14 days from the date on which the notice of withdrawal is received.
However, in the case of the sale of goods, the Seller is not required to issue the refund before the goods have been returned or until the Consumer provides evidence that the goods have been sent back, whichever occurs first, unless otherwise provided by law or determined by the Seller.
Payments will be refunded using the same payment method used by the Consumer for the original transaction unless the Consumer and the Seller agree on another method that does not result in additional fees for the Consumer.
If the Consumer selected a more expensive delivery method than the least expensive standard delivery method offered by the Seller, the Seller is not required to refund the additional costs representing the difference between these delivery methods. Pasted markdown
9. Exceptions to the Right of Withdrawal
The Consumer may not withdraw from the contract in cases stipulated by law.
Under Section 21(4), the customer is responsible for any diminished value of the goods if the goods have been handled beyond what was necessary to establish their characteristics and functionality.
In the case of VINIGHT products, this may particularly apply to goods manufactured according to the Consumer's specifications or goods made to order according to the customer's individual requirements.
Simply selecting a normally available size, colour or product variant does not automatically mean that the product is made to order. Pasted markdown
10. Liability for Defects and Complaints
The Seller is liable to the Consumer for defects in the goods to the extent stipulated by the applicable laws of the Slovak Republic.
If the delivered goods are defective, the Consumer has the right to exercise their statutory rights arising from liability for defects.
A complaint may be submitted to:
E-mail: vinight@vinight.sk
Complaints address: Riadok 415/47, Drahovce, 92241
When submitting a complaint, it is recommended to provide:
- first and last name,
- order number,
- identification of the product concerned,
- description of the defect,
- preferred method of resolving the complaint, where available given the nature of the defect,
- photographs of the defect, if they may assist in assessing the complaint.
Failure to provide a photograph does not in itself deprive the Consumer of their statutory rights.
Section 12(1): a likeness, image or audio-visual recording of a natural person may generally be created or used only in accordance with GDPR.
The Seller will provide the Consumer with written confirmation of the resolution of the complaint in accordance with applicable legislation.
The Consumer's rights arising from liability for defects, the conditions for exercising such rights and the method of handling complaints are governed primarily by the relevant provisions of the Civil Code and related legislation.
Normal wear and tear resulting from the use of the product, or damage caused by improper use, maintenance or mechanical damage caused by the Buyer, is not considered a defect for which the Seller is liable, unless applicable law provides otherwise. Pasted markdown
11. Garment Care
When using and caring for clothing, the Buyer must follow the care symbols and instructions provided on the product or its label.
Damage caused by care or maintenance contrary to these instructions may not constitute a defect for which the Seller is liable. Pasted markdown
12. Gifts and Promotional Offers
The Seller may provide gifts, discount codes or other promotional benefits with orders under the terms of a particular promotion.
The terms of a particular promotion will be specified on the website or alongside the relevant offer.
If a gift is conditional upon reaching a specified purchase value and the Consumer subsequently withdraws from part of the contract so that the value of the retained goods no longer meets the conditions of the promotion, the customer is not entitled to exchange the gift, in accordance with the conditions of the relevant promotion and applicable legislation. Pasted markdown
13. Discount Codes
Discount codes may be used subject to the conditions specified for the relevant promotion.
Unless otherwise stated, discount codes cannot be combined.
A discount code cannot be applied retroactively to an order that has already been completed. Pasted markdown
14. Alternative Dispute Resolution
If the Seller rejects a request for remedy or fails to respond within the statutory period, the Consumer has the right to submit a proposal to initiate alternative dispute resolution with the competent dispute resolution entity under the conditions stipulated by law.
The competent entity may be the Slovak Trade Inspection (SOI). Pasted markdown
15. Personal Data Protection
The processing of customers' personal data is governed by the applicable data protection legislation.
Details regarding what personal data the Seller processes, the purposes for which it is processed, how long it is retained and the rights of the data subject are set out in a separate Privacy Policy. Pasted markdown
16. Copyright and Online Store Content
The content of the VINIGHT online store, including in particular original graphic designs, photographs, texts, logos, the brand name and other content, is protected by intellectual property rights.
Without the prior consent of the relevant rights holder, protected content may not be copied, reproduced, modified or used for commercial purposes without authorisation.
Third-party rights remain unaffected. Pasted markdown
17. Final Provisions
Legal relationships not regulated by these Terms and Conditions are governed by the laws of the Slovak Republic, in particular the relevant provisions of the Civil Code and consumer protection legislation.
If any provision of these Terms and Conditions is invalid or ineffective, this does not affect the validity of the remaining provisions.
The Seller is entitled to reasonably amend or supplement these Terms and Conditions. The version of the Terms and Conditions effective at the time the relevant contract was concluded applies to each individual order.
These General Terms and Conditions enter into force on 20 September 2026.
